
The “Saga Club 2008 Sign-up Contest” (the “Contest”) is intended for participation only in U.S.A and Canada; shall be construed according to, and governed exclusively by, the United States law. PROMOTION DESCRIPTION: The “Icelandair Saga Club Contest for NetClub members Contest” begins on July 9, 2008 at 12:00 p.m. Eastern Standard Time (“EST”) and ends on July 29, 2008 at 5:00 p.m. EST (the “Promotion Period”). At the end of the Promotion Period, a random drawing will be conducted to select the winner for the Grand Prize, as described in detail below. Entry in the Contest does not constitute entry into any other promotions, contests or sweepstakes. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Icelandair, 5950 Symphony Woods Rd., Suite 410, Columbia, MD 21044 (collectively, “Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: Only legal residents of the United States, Canada and located in North America at the time of entry who are eighteen (18) years of age or older are eligible to enter the contest. No purchase necessary and VOID WHERE PROHIBITED BY LAW. See the Prize/Odds Section of these Official Rules (below) for additional restrictions on winners who are under the age of eighteen (18). Officers, directors, and employees (and immediate family members and those persons living in the same household of any such officers, directors and employees) of Sponsor, and each of Sponsor’s subsidiaries, affiliates, distributors, retailers, sales representatives, and advertising and promotion agencies, and any other person associated with the Sweepstakes (collectively, the “Promotion Entities”) are ineligible to enter the Contest or win a prize.
All website entries must be received by the end of the Promotion Period in order to participate. The Website's clock will be the official time keeper of this Contest. Such information may be shared with Sponsor’s promotional partners if and to the extent entrants agree at the time of entry, and in such event, the use of such information by such promotional partners will be in accordance with each such promotional partner's own independent privacy policy. Unless otherwise provided in these Official Rules, such information will be used in accordance with the Website's privacy policy. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of such entry. Entry must be made by the entrant. Entries made by any other individual or entity, and/or originating at any other web site or E-mail address, including but not limited to commercial sweepstakes notification and/or entering service sites, will be deemed invalid and disqualified from the Contest. The use of any device to automate the entry process is considered to be a direct violation of Contest policy and will result in immediate disqualification of any and all associated entries. All internet access and usage charges are the sole responsibility of the entrant.
CANCELLATION: If for an reason the Contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion, to terminate, modify or suspend the Contest.
WINNER NOTIFICATION: The Grand Prize winner will be randomly selected from all eligible entries received throughout the Promotion Period. The random drawing is currently scheduled to be conducted on or about July 29, 2008 by Sponsor, using methods within its sole discretion. The potential winner will be notified by telephone and/or overnight mail and/or E-mail. Sponsor will attempt to contact potential winners using the E-mail address and other contact information provided by the entrant at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within five (5) business days of the first notification attempt, or if the prize or prize notification is returned as declined, unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner will be randomly selected. Sponsor will successively attempt to contact up to three (3) potential winners in accordance with such procedure, and if there is still no confirmed winner after such attempts have been made, the applicable prize may go unawarded. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner will be randomly selected.
WINNER NOTIFICATION: The Grand Prize winner will be randomly selected from all eligible entries received throughout the Promotion Period. PRIZE/ODDS: All sign-up entries will receive 1,000 Award points. ONE (1) Grand Prize Winner will receive an additional 120,000 Award points. Sponsor reserves the right to request proof of age and proper form of identification.
Prizes will be delivered to your account after sign-up, must reside in the U.S.A or Canada and have a valid home address in North America. Limit one prize per person, family, or household.
GENERAL PRIZE CONDITIONS: Grand Prize winner shall be solely responsible for all federal, state and/or local taxes, sales tax, surcharges, service charges, delivery, processing and handling fees, and all other costs incurred in claiming the prize. It may be legally necessary under Revenue Canada rules (as determined by Sponsor in its sole discretion) for the prize winner to pay the amount of any tax before receiving the prize, if applicable. Grand Prize winner shall be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). The verified winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of her or his name, voice, and likeness, along with her or his address and any statements made or attributed to such winner (collectively, "Attributes") in any and all media, now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe for advertising and promotional purposes in connection with the Contest and other promotions without further compensation, and releases Sponsor from all claims arising out of the use of such Attributes. Any prizes depicted in promotional packaging or otherwise in connection with this Contest are for illustrative purposes only and may not represent the actual prize(s) that is(are) awarded. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest promotional materials and the terms and conditions of these Official Rules, these Official Rules shall prevail and govern. GENERAL RELEASE: Acceptance of prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media currently known or hereafter developed, in perpetuity, without further compensation. Entrants agree that Sponsor (A) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or in any Contest related activity, or from any Contest entrant’s acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to entrant’s computer system that is occasioned by accessing the Website or participating in the Contest or downloading any materials from the Website, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for typographical errors; or for lost, interrupted, inaccessible or other connections; or for servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind of nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software generated or other automated multiple entries will be accepted. In the event of a dispute as to the identity of an entrant, any on-line entry will be deemed submitted by the authorized account holder of the E-mail account from which it was sent, provided such account holder must still meet the eligibility requirements for the Contest. The authorized email account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning E-mail addresses for the domain associated with the submitted E-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the E-mail address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS REGARDING THE CONSTRUCTION, VALIDITY, AND ENFORCEABILITY OF THESE OFFICIAL RULES SHALL BE INTERPRETED AND CONSTRUED ACCORDING TO, AND GOVERNED BY, THE INTERNAL LAWS OF THE STATE OF MARYLAND, EXCLUDING SUCH LAWS THAT MIGHT DIRECT THE APPLICATION OF ANY OTHER STATE’S LAWS.
BINDING ARBITRATION PROVISION: By participating in the Contest, each entrant agrees that: any and all disputes that may arise with, or claims entrant may have against, either Sponsor relating to, arising out of, or connected in any way with: (i) the Contest, (ii) the awarding or redemption of prizes, (iii) these Official Rules, or (iii) the determination of the scope or applicability of this agreement to arbitrate, shall be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator in accordance to the Forum’s Code of Procedure. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed by the participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Contest. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and / or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the authority, power, or right to alter, change, amend, modify, add, or subtract from any provision of these Official Rules. Each Contest entrant further agrees, if applicable in Contest entrant’s jurisdiction, that (i) any and all claims and arbitration awards shall be limited to actual out-of-pocket losses and expenses incurred by entrant in connection with this Contest but in no event shall attorneys' fees be awarded to either party; and (ii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket losses and expenses. In the event that the administrative fees and deposits that must be paid to initiate arbitration against Sponsor exceeds $125, and the participant is unable (or not required under the applicable Code of Procedure) to pay the additional fees and deposits, Sponsor agrees to pay them and/or forward them on the participant’s behalf, subject to ultimate allocation by the arbitrator. Provided that the participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent such arbitration from being cost-prohibitive.
